Terms & Conditions
These Terms and Conditions ("Terms") govern your relationship with the operator of the online gaming service marketed as "Ruby Fortune" and made available to Canadian residents through the website rubyfortune-win.com and its related Canadian project Ruby Fortune (collectively, the "Website"). By accessing or using the Website, registering an account, or participating in any games or promotions, you agree to be bound by these Terms. Effective date: 1 January 2026.
Definitions
For the purposes of these Terms, the following definitions apply:
- Operator means:
- Bayton Ltd, a limited company registered in Malta with registered office at 9 Empire Stadium Street, Gzira, GZR 1300, Malta, holder of Malta Gaming Authority B2C Gaming Service Licence MGA/B2C/145/2007, which operates the Website for players located in the Rest of Canada (outside Ontario); and
- Cadtree Limited, a limited company licensed by iGaming Ontario (iGO) to offer online gaming to residents of Ontario, which operates the Website and related domains for Ontario players.
- Website means rubyfortune-win.com, including any Canadian review or mirror implementation such as Ruby Fortune, and any related domains or subdomains that link to these Terms, including legacy domains such as rubyfortune.com and regional domains such as rubyfortune.ca where they present these Terms or incorporate them by reference.
- User or Player means any natural person who accesses the Website, opens an account, places wagers, or participates in promotions.
- Account means the personal player account you open on the Website for the purpose of participating in online gaming services.
- Games means any casino, slots, live casino, table game, or other interactive gambling product offered on the Website.
- Bet or Wager means any amount of real or bonus funds staked on a Game or promotion.
- Bonus means any promotional value, including but not limited to bonus funds, free spins, free bets, cashback, or loyalty rewards, credited to your Account subject to specific terms.
- Real Money Balance means funds you have deposited, plus any winnings derived therefrom, less withdrawals and fees.
- Bonus Balance means bonus funds and winnings generated from such funds that are subject to wagering or other conditions before becoming withdrawable.
- Ontario Player means a User whose verified residence is within the province of Ontario and who is served under Cadtree Limited's iGaming Ontario licence.
- Rest-of-Canada Player or RoC Player means a User located in Canada outside Ontario, served under Bayton Ltd's MGA licence (and any applicable legacy Kahnawake licensing).
- Regulators means, as applicable, the Malta Gaming Authority ("MGA"), the Kahnawake Gaming Commission ("KGC"), iGaming Ontario (iGO), and any other governmental or regulatory authority having jurisdiction over the Operator or the Player.
- ADR means alternative dispute resolution service providers such as eCOGRA that may handle unresolved disputes between you and the Operator.
Account Registration
Eligibility and Age Requirements
- You may only open an Account if:
- You are a natural person acting on your own behalf and not as part of any business or syndicate;
- You are at least 18 years old and meet the minimum legal gambling age in your province or territory of residence. Where the legal age is higher (for example, 19 years in Ontario and several other provinces), you must meet that higher age;
- You are resident in a Canadian jurisdiction where online gambling with the Operator is lawful and not prohibited by local law; and
- You are not excluded, self-excluded, suspended, or otherwise prohibited from gambling with us or with any other operator by a regulator.
Registration Process and KYC
- To create an Account, you must:
- Complete the online registration form on the Website, providing accurate and complete information including your full name, date of birth, address, contact details, and any other information requested;
- Confirm your acceptance of these Terms and all applicable policies, including the privacy policy and bonus terms;
- Verify your email address and, where required, your mobile number; and
- Undergo identity verification ("KYC") and any anti-money laundering ("AML") checks we deem necessary.
- We may request documentation at any time, including but not limited to:
- Government-issued photo identification;
- Proof of address (e.g., utility bill or bank statement);
- Proof of ownership of payment methods used (e.g., card or bank statement); and
- Source-of-funds or source-of-wealth information if required by law or our internal policies.
- Failure to provide requested documentation promptly may lead to suspension of your Account, withholding of withdrawals, or account closure.
User Obligations
- You agree to:
- Provide accurate, current, and complete registration information and keep it updated;
- Maintain the confidentiality of your username, password, and security details, and not share them with any third party;
- Accept full responsibility for all activity under your Account, including any bets placed, whether or not authorized by you, unless caused by our negligence or fraud;
- Use the Website solely for personal entertainment and not for any commercial or professional purpose; and
- Refrain from opening more than one Account per person, household, IP address, device, or payment method, unless expressly permitted by us in writing.
- We may close duplicate Accounts and:
- Void bets and cancel bonuses associated with duplicate Accounts; and
- Return any remaining Real Money Balance, subject to deduction of reasonable administrative and investigation costs and any amounts owed to us.
Betting & Gameplay Rules
Placing Bets
- To place a bet:
- You must be logged into your Account and have sufficient available Real Money Balance or eligible Bonus Balance;
- You must select the relevant Game, review the bet amount, pay table, and rules displayed within that Game; and
- Confirm the bet by following the on-screen instructions. Once accepted by our servers, the bet is considered final.
- Minimum and maximum bet limits vary by Game and may be changed at any time. Current limits are displayed within each Game.
- The outcome of each Game is determined by our certified random number generator (RNG) or by the rules of the live table, as applicable. Our records are conclusive in determining the outcome of bets and balances.
Cancellation and Modification of Bets
- Once a bet has been accepted by our systems and the game round has been initiated, you cannot cancel or modify the bet, except where:
- A Game malfunction, technical error, or misconfiguration occurs; or
- We expressly cancel the bet due to an obvious error (for example, incorrect odds, mis-set pay table, or clearly erroneous payout).
- In the event of:
- System malfunction: All affected bets and game rounds are void, and the stake or deducted amount will be restored to your Account's Real Money Balance or Bonus Balance, as applicable.
- Disconnection: The result recorded on our servers will stand. Where possible, you may re-open the Game upon reconnection to see the concluded result.
Conduct in Games, Live Casino and Chats
- You must conduct yourself respectfully and lawfully in all interactions on the Website, including live casino tables and any chat or messaging functions. In particular, you must not:
- Use abusive, offensive, defamatory, discriminatory, or threatening language;
- Promote hate, violence, illegal activities, or other gambling operators;
- Harass or intimidate other Players, dealers, or staff; or
- Share personal data of others or solicit personal data from other Players.
- You must not engage in any:
- Fraud, collusion, or use of bots or automated software;
- Exploitation of bugs, glitches, or technical loopholes;
- Use of VPNs, proxies, or other tools to disguise your location in order to circumvent regional restrictions; or
- Chip dumping, advantage play based on unauthorized access to information, or any other unfair strategy violating game rules.
- We may suspend or terminate your Account, withhold winnings, and notify Regulators where we reasonably suspect prohibited conduct.
- Gambling involves financial risk and may lead to loss of money. You are solely responsible for managing your gambling within your personal limits. The Website provides responsible gambling tools (such as deposit limits, time-outs, and self-exclusion) in accordance with applicable Canadian and Maltese regulations and the Ontario iGaming framework, where applicable.
Bonus Terms
Bonus Activation and Eligibility
- Bonuses and promotions on rubyfortune-win.com are offered at the Operator's discretion and may be subject to additional specific terms displayed on the Website or via associated domains such as rubyfortune.com/bonus-terms/.
- Unless expressly stated otherwise:
- Bonuses are limited to one per person, household, IP address, device, payment method, and Account;
- Eligibility may depend on your province of residence (for example, specific rules apply to Ontario Players under the iGaming Ontario framework); and
- We may require successful KYC verification before granting or allowing withdrawal of any bonus-related winnings.
Wagering Requirements and Timeframes
- Each Bonus is subject to wagering requirements and time limits specified in the bonus offer and on the applicable bonus terms page. Common conditions may include:
- A minimum wagering multiple of the bonus amount and/or deposit amount before withdrawal (for example, a multiple of the bonus funds);
- Contribution weighting, where different Games contribute differently to wagering (e.g., slots typically contribute more than table games); and
- A defined period (for example, a number of days from activation) within which wagering must be completed, after which the Bonus and associated winnings may be forfeited.
- Your Real Money Balance is generally wagered before your Bonus Balance unless otherwise stated. If you withdraw funds before meeting wagering requirements, Bonuses and related winnings may be cancelled.
Prohibited Games and Bonus Abuse
- Certain Games may be excluded from bonus wagering or may have reduced contribution percentages. These restrictions are stated in the specific bonus terms and on the bonus terms page.
- You must not engage in "irregular play" or bonus abuse, including but not limited to:
- Placing equal, zero, or low-margin bets or hedge bets to meet wagering with minimal risk;
- Using bonus funds on restricted Games or features (e.g., certain progressive jackpots or high-risk game features) contrary to published rules;
- Deliberately delaying game rounds (for example, storing free spins or bonus features for later use with real money bets); or
- Abusing multiple Accounts, devices, or identities to claim repeated bonuses.
- We may cancel Bonuses, forfeit bonus-related winnings, and close Accounts where we reasonably suspect bonus abuse.
Combining Promotions
- Unless expressly stated, promotions cannot be combined. Only one active welcome or deposit Bonus may apply to a single deposit or period.
- Where multiple promotions are available, the order of application and interaction between promotions are as described in each offer's specific terms. In the event of conflict, the specific promotion terms prevail over any general bonus terms, and both prevail over these Terms to the extent of any inconsistency relating solely to that promotion.
Payments & Withdrawals
Deposit Methods
- The Website supports a range of deposit methods appropriate for Canadian Players, which may include:
- Credit and debit cards (e.g., Visa, Mastercard, where permitted);
- Bank transfers and local online banking solutions (e.g., Interac and similar services where available);
- Selected e-wallets and prepaid vouchers; and
- In some cases and where permitted by law and the Operator's policies, digital asset or crypto-related payment solutions offered via regulated third-party providers.
- Available methods, minimum and maximum deposit amounts, and any fees or exchange rate considerations are displayed in the cashier section of the Website.
- We do not guarantee that all methods will be available at all times or for all jurisdictions; offerings may differ for Ontario Players and RoC Players in accordance with regulatory requirements.
Withdrawals
- Withdrawals are generally processed using the same method used for deposit, where technically feasible and consistent with AML regulations. Where this is not possible, alternative methods may be offered.
- Before processing a withdrawal, we may:
- Require full KYC verification of your identity and address;
- Request evidence of ownership of the payment method; and
- Conduct risk and AML checks. This may result in additional document requests or reasonable delays.
- Minimum and maximum withdrawal limits and estimated processing times are shown in the cashier. Internal processing times are separate from any delays introduced by banks, payment providers, or third parties.
- We reserve the right to:
- Split large withdrawals into instalments over a defined period in accordance with internal limits and regulatory requirements;
- Withhold withdrawals where we reasonably suspect fraud, AML breaches, chargebacks, bonus abuse, or other violations of these Terms; and
- Charge reasonable administrative fees where permitted by law, for example for processing inactive accounts or chargebacks.
Refunds and Chargebacks
- Deposits are generally not refundable once used to place bets. In limited circumstances (for example, where a technical issue results in duplicated transactions), we may consider a refund at our sole discretion.
- You must not request chargebacks unjustifiably. If you initiate a chargeback:
- We may suspend your Account and any related accounts;
- We may recover chargeback amounts, costs, and fees from any balances or future deposits; and
- We may report fraud or payment disputes to relevant payment providers and Regulators.
Currency
- For Canadian Players, the primary Account currency is generally Canadian dollars (CAD). Where a different currency is used, exchange rates and any conversion fees are determined by the payment provider or by us as indicated in the cashier.
Limitation of Liability
Operator Obligations
- The Operator will:
- Provide the Games and services with reasonable skill and care;
- Ensure that the RNG and Games are tested and certified by independent testing laboratories such as eCOGRA, to the extent required by the MGA, iGaming Ontario, and other Regulators;
- Maintain accurate records of bets, wins, and balances; and
- Comply with applicable regulatory frameworks, including MGA licence MGA/B2C/145/2007, the Ontario iGaming framework under iGO, and any relevant Canadian laws.
Exclusions of Liability
- To the maximum extent permitted by law, the Operator is not liable for:
- Any loss or damage arising from:
- Your failure to protect your Account credentials;
- Unauthorized use of your Account where we are not at fault;
- Internet, network, or communication failures, delays, or interruptions;
- Hardware, software, or device incompatibility or malfunctions on your side; or
- Force majeure events, including regulatory changes beyond our control.
- Indirect, consequential, or special damages, including loss of profits, business, data, or goodwill;
- Losses arising from third-party services or sites linked from the Website (including payment providers and external websites such as regulator or ADR portals); or
- Any errors in the published odds, pay tables, or game rules where we correct such errors and either void or adjust affected bets in accordance with the corrected information.
- Any loss or damage arising from:
Maximum Liability
- Where the Operator is found liable to you in connection with a particular bet, Game, or transaction, our maximum aggregate liability, to the extent permitted by law, will not exceed:
- The amount actually staked by you on the relevant bet or Game round; or
- Where the claim does not relate to a specific bet, the lesser of:
- Your net deposits to the Website over the preceding six (6) months; and
- CAD 10,000 (or equivalent in another currency), unless a higher amount is required by applicable law.
- Nothing in these Terms excludes or limits:
- Our liability for death or personal injury caused by our negligence;
- Our liability for fraud or fraudulent misrepresentation; or
- Any liability that cannot be excluded or limited under applicable Canadian or Maltese law or the Ontario iGaming framework.
Intellectual Property Rights
- All intellectual property rights in and to the Website, including but not limited to:
- The "Ruby Fortune" brand as used in connection with rubyfortune-win.com and related domains;
- Logos, trade names, trademarks, domain names, and trade dress;
- Website design, layout, text, graphics, audio, video, software, and underlying source code; and
- Game content licensed from third-party providers,
- You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and Games solely for personal, non-commercial entertainment purposes in accordance with these Terms.
- You must not:
- Copy, reproduce, distribute, modify, translate, decompile, reverse engineer, or attempt to derive the source code of any software on the Website, except as expressly permitted by applicable law;
- Use any automated tools (including crawlers, spiders, robots, or scrapers) to access or interact with the Website, except for standard search engine indexing subject to robots.txt; or
- Use our trademarks, logos, or brand elements without our prior written consent.
Privacy & Data Protection
- Your personal data is processed in accordance with our privacy policy, which is made available on rubyfortune-win.com and may also be referenced on related domains such as rubyfortune.com/privacy/.
- The privacy policy explains:
- What personal data we collect, such as identification, contact, and transactional data;
- How we use and share that data, including for KYC, AML, responsible gambling, and regulatory compliance;
- Your rights under applicable data protection laws; and
- How long we retain your data and how we keep it secure.
- By using the Website, you acknowledge that your data will be processed in accordance with the privacy policy and relevant laws, including applicable Canadian privacy laws, Maltese regulations, and, where relevant, European data protection standards.
Changes to Terms
- The Operator may modify these Terms from time to time, for example to:
- Reflect changes in law, regulation, or regulatory guidance (including requirements from the MGA, iGaming Ontario, or other Regulators);
- Address new products, services, or features; or
- Clarify existing provisions and improve user protection.
- We will notify you of material changes by one or more of the following methods:
- Email to the address registered with your Account;
- On-site notifications or banners when you log in; or
- A prominent notice on the Website specifying the effective date of the updated Terms.
- Updated Terms will take effect on the date specified in the notice. Continued use of the Website after that date constitutes your acceptance of the changes.
- If you do not agree to the updated Terms, you must stop using the Website, close your Account in accordance with the procedures provided, and, where permitted by law and subject to regulatory requirements, withdraw any eligible Real Money Balance.
Termination & Suspension
Termination by You
- You may request closure of your Account at any time by using the tools available on the Website or by contacting customer support.
- Upon closure:
- Any pending bets will be settled in the normal course where possible;
- Any remaining Real Money Balance, subject to KYC and AML checks and any outstanding obligations to us, will generally be returned to you using an appropriate payment method; and
- Bonus funds and uncompleted wagering requirements will be cancelled, and any associated bonus winnings may be forfeited.
Suspension or Termination by the Operator
- We may suspend or terminate your Account (and, where appropriate, related Accounts) in whole or in part where we reasonably believe that:
- You have breached these Terms or any applicable Game rules or bonus terms;
- You have engaged in fraud, collusion, money laundering, terrorist financing, or other criminal or unlawful activity;
- You have provided false or misleading information or failed to provide required documentation;
- Your behavior poses a risk to responsible gambling objectives or to other Players or staff; or
- We are required to do so by a Regulator, court order, or applicable law.
- During suspension, you may not:
- Deposit or place bets; and/or
- Withdraw funds, except where mandated by law or regulator instruction.
- Following investigation, we may:
- Lift the suspension and restore full access; or
- Close your Account, in which case:
- We will, subject to regulatory requirements and our rights to withhold funds in cases of fraud or AML concerns, return any Real Money Balance to you; and
- Bonus funds and non-withdrawable balances will be cancelled.
- In cases of confirmed unlawful conduct, we may withhold or confiscate balances and winnings to the extent permitted by law and notify Regulators and law enforcement.
Governing Law & Jurisdiction
Ontario Players
- For Ontario Players:
- These Terms and your use of the Website are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, as well as the regulatory framework administered by iGaming Ontario (iGO) and the Alcohol and Gaming Commission of Ontario (AGCO).
- Disputes should first be raised with the Operator's customer support and internal complaints process. If unresolved, you may use the player support channels of iGaming Ontario, including the resources available at https://igamingontario.ca/en/player/player-support.
- Subject to mandatory dispute resolution processes, the courts of Ontario will have non-exclusive jurisdiction over disputes arising out of or relating to these Terms.
Rest-of-Canada Players (RoC)
- For Players located in Canada outside Ontario:
- These Terms, your Account, and your use of the Website are governed by the laws of Malta, without prejudice to any mandatory provisions of Canadian law that may apply in your province or territory of residence.
- Disputes should first be raised through our internal complaints procedure. If you remain dissatisfied, you may:
- Refer the matter to the ADR service provider eCOGRA via https://ecogra.org/alternative-dispute-resolution/; and/or
- Lodge a complaint with the Malta Gaming Authority using the player complaint form at https://mga.org.mt/player-hub/lodge-a-complaint/, in respect of services provided under licence MGA/B2C/145/2007.
- Subject to the ADR and regulatory mechanisms above, the courts of Malta will have non-exclusive jurisdiction over disputes arising from these Terms.
Other Provisions
- Nothing in this section limits your rights under applicable consumer protection or gambling legislation in Canada. Where there is a conflict between these Terms and mandatory legal provisions, those legal provisions prevail.
- If there is any inconsistency between these Terms and the terms published on an official Operator domain (including, without limitation, any terms published on rubyfortune.com/terms/ for RoC Players or on rubyfortune.ca for Ontario Players), the terms published on the relevant official domain will govern your relationship with the Operator to the extent of that inconsistency.
